Responsible for effective operations of the BH disability/risk management, litigation and claims management, and risk transfer, retention and financing including oversight of the third party administrator of the workers' compensation and long term disability programs.  Additional responsibility includes the supervision of internal admininstrative staff for these programs.  Responsible for self insured and purchased commercially insured programs including risk evaluation, retention, transfer and risk financing.  Collaborates with cross-departmental team to establish and coordinate loss prevention programs for all exposure areas.

Oversee claims and litigation management, recommend and advise management concerning liability and actions to be taken.  Assure maintenance of appropriate files and records of claims and litigation.  Supervise the preparation and coordination of periodic and special reports required by various agencies and insurance carriers.

Recommend, implement and maintain comprehensive system disability insurance programs including self-insurance programs for WC, LTD, and STD.  Determine financial allocation of premium among insured entities.  Accountable for self-insured and commercially insured disability management programs. Responsible for regulatory compliance under ERISA, DOL, Massachusetts Department of Insurance and Division of Industrial Accidents, EEOC (ADA).

Direct, supervise and coordinate personnel and activities in assigned area including evaluation, scheduling, orientation, and training; also makes effective recommendations on employee hiring, transfer, promotion, wage change, discipline, termination and similar action.

Work closely with TPA to ensure WC, STD, FMLA/PFML and LTD programs are administered effectively.  Implement and review monthly, quarterly, and annual reporting measures to perform analytics of WC, LTD, STD and FMLA.

Develop and present educational programs to medical, professional and technical staff regarding the appropriate administration, timekeeping, and resolution of WC, LTD, STD and FMLA.  Work with Return to Work Coordinator to develop alternative return to work programs for employees with restrictions.

Responsible for plan designs, underwriting and financial funding of LTD and WC programs. Includes the oversight of the TPA administration and payment of all disability claims, including medical case management, utilization review, and management of a Preferred Provider Agreement, cost allocation, and establishment of reserves for self-funded and self-insured plans.

Responsible for administration of all forms of Leave Management, including FMLA, EIB, PTO, Medical Leave, Small Necessities Leave, Massachusetts Earned Sick Leave, etc., while creating and ensuring continuity in leave administation for employees.  Develops programs and processes that ensure employees move to appropriate leave status as situation warrants in a seamless manner.  Works with managers to ensure leaves are managed appropriately and are coded appropriately in the timekeeping system.

Responsible for the oversight of Baystate Health's compliance with the Americans with Disabilities Act Amendment Act, the Rehabilitation Act of 1973, MA Pregnant Workers Fairness Act and other relevant federal and state laws pertaining to candidates and employees with disabilities.  Provides strategic guidance and operational assistance to the ADA Case Manager in the administration of claims, development of reporting and coaching to employees and leaders to minimize risk to the organization.

Responsible for the oversight of Baystate Health’s Modified Duty Program and other Return To Work programs.  Provides strategic guidance and operational assistance to the Return To Work Nurse Case Manager role to further support employee’s returns, decrease occupational and non-occupational claim durations and minimize the risk to the organization.

This role is responsible for the compliance of the evolving federal and state leave regulations that govern employee job protection and wage replacement as applicable. Must partner with internal stakeholders to adapt HR policies, HR and payroll systems, develop employee and manager communications and establish workflow processes as regulations are introduced or shift.  It is the role of the manager to be the subject matter expert and ensure compliance with these regulations.
